Salaam Brother Khan,
He should follow what his heart says and leave the other matter to Allah... Other things should not concern him... JazakAllah... Posted by Sanna fq

Your friend should pray to Allah for guidance. Most specifically,he should perform the Nafilatul Istikharu-Nabawiy.Allah will definitely guide him!

The first thing he needs to do is disassociate from all groups you mention and should see himself as a Muslim only. The Deen is simple and straight forward, why make it complicated with extended aqeedah and involve oneself with things which took root after RasulAllah (SAW) and had no concept in his lifetime. Secondly The four school of thought may have different opinion on how to validate or invalidate a talaq or even in the shia case it might be different but the facts which need to be kept in mind are the, right to talaq, the clearly defined grounds to seek talqh yet how much it is disliked BY ALLAH(SWT), there is no room for regret that is why if you divorce a women you can not marry her again unless she has married to some one else first, the objective is clear, to prevent the divorce in the first place. The problem is men have been abusing the laws from the very beginning and even before Islam they were marring as many women they could afford and dumped them at will with out rights or any fair share to part. The Quran specifically gives the Talqh rights to Women, rights they never had before that.
Allah(SWT)is well aware of intentions in all cases and since a marriage constitutes a legal witnessed contract between man and woman so will be a divorce, NO MAN CAN SAY TALAQ TO A WOMAN ONCE OR 3 TIMES AND CLAIM NOW HE IS FREE FROM HIS CONTRACT NOR A WOMEN SHOULD ACCEPT A VERBAL DIVORCE WITH OUT LEGAL WITNESSES PRESENT AND OBLIGATIONS FULFILLED IN CASE OF A UTMOST NECESSARY DIVORCE. DO NOT REDUCE A MARRIAGE, SOMETHING ORDAINED BY ALLAH(SWT)INTO A MUTTA LIKE SHAM. Guidance does not come by turning to men and their knowledge and opinions but only when you truthfully and honestly turn to Allah(SWT) then he will filter through confusion and one will see what he did not see before hence at peace within. Brother Khan, It is very simple, for Religious guidance for the Laymen you follow the Early Scholars not the latter, the Four Maddhabs have been fixed for this matter indeed for the layman, for this will not lead him to a distant minute opinion, nor will this lead him to a plethora of opinions. Stick to one of the Schools and dont worry about the bickering in the indian sub continents, this will be better. As for the Talaq issue if you are talking about whether 3 Talaqs constitutes one or three, then according the the Four Schools this constitutes a Full Talaq al Bayn. WaSalaam. Posted by Zainul

Zainul has ever a woman exercise her right to full talaq by giving 3 verbal talaqs and if one has, was she given a rightful share upon divorce? While for the marriage there are witnesses and a binding contract, should it be not the same for divorce in other words to dissolve that contract taken in the name of Allah(SWT)?
BTW Have you read all the divorce related hadith? Could you elaborate on what is considered a actual 1 talaq and how consecutive 3 talaqs constitute a full talaq al bayn Posted by TheMehdi

Salaam,
In giving Talaq one doesn't need a witness, because it is such a strict matter we shouldn't even in the state of joke say Talaq, as you said: "there is no room for regret that is why if you divorce a women you can not marry her again unless she has married to some one else first, the objective is clear, to prevent the divorce in the first place." Some Scholars have even said if it written in writing that still constitutes Talaq. As for Marriage, it is binding to have witnesses, because of the marriage contract, this in itself was stipulated by our Prophet [SAW], now if a women gets divorced then she will announce that she was divorced, and if the husband lies then they are both sworn on oath, cursing one another, and after that they will have automatic divorce, hence the women will have to get her rights and that what was given in her dowry, Mahr. So either way She has rights. My brother i have studied this issue of Talaq for a very long time, i have read all the hadith related to this, i am even well acquainted with the Salafi opinion which is totally shambles. If a man gives his wife 3 Talaqs on one spot, then this is a full divroce, but the Salafis have gone astray from the Jama'ah on this issues [nothing new if you ask me], infact the Salafis are making people commit zina today with this wierd wonderful opinion of theirs. If you want the proofs and further elaboration please do let me know. WaSalaam. Posted by Zainul
